1. Contractor 

The contract is made between the customer and Thomas Jarosch, Plant Lodge, Gaillardstraße 14b, 13187 Berlin, VAT ID:. DE154195971. You can contact our customer service for questions or complaints by e-mail at service@plantlodge.com.

2. Offer and Conclusion 

2.1 The presentation of products in our online shop is not a legally binding offer, but a call to order. Errors excepted.
2.2 By clicking the "Buy" button, you enter a binding order for the items listed on the order page. The sales contract is concluded when we accept your order with an order confirmation by e-mail immediately after receiving your order.

3. Withdrawal 

3.1 Consumers have a fourteen day return policy, see also page revocation on this site. The right expires in association with Download products once the product has been submitted online.

4. Prices and shipping costs

4.1 The prices listed on the product pages include the VAT and other price components.
4.2 Delivery is available for download, so no shipping costs will be charged. Should there be an individual agreement to ship on media, the shipping an handling cost are calculated individually and are then contained in the respective offer.

5. Delivery

5.2 Once the booking is confirmed by the bank or the online payment system there will be send an email to the buyer, in which the links to download the products are included.

6. Payment
6.1 Payment may be made by PayPal or payment in advace.
6.2 The right to summation is available only if your claims are legally established in court or are undisputed or acknowledged in writing by us.
6.3 You may only withhold payment if the claims are from the same contractual relationship.

7. Retention 

Until the full payment the goods remain our property.

8. License Terms
The seller grants to the customer a non-exclusive, non-transferable, non-sublicensable right to use the pictures, models and textures, such as the right to copy the products on his computer to create backups, modify, and use it to create still images and videos. The products can be used as part of a game if they are delivered in a proprietary format that does not allow further use. In this case, the origin of the pictures, models and textures has to be referred in the description of the game. The license is personal and not transferable. The products may not become used by third parties. The customer is not entitled to publish the pictures, models or textures or parts of them, distribute or sell them. The customer acquires no further claim to the work, and especially not claim ownership of any copyright or other intellectual property rights.

9. Liability
The seller is not liable for lack of commercial success, lost profits and consequential damages.

10. Further information about ordering 

If you have found a product, you can add it to cart without obligation by clicking on the "add to cart" button. You can see the content of your basket without obligation at any time by clicking on the "View Cart" button. The products can be removed at any time by clicking the "Remove item from shopping basket" (trash can icon) from the cart. If you want to buy the products in your cart, click the button "Check out". Please make sure to enter your data. The mandatory fields are marked with *. A registration is not required. Your data will be transferred in encrypted mode. After entering your data and your choice of payment you can access the order page where you can check your entries again via the button "To checking of order". 12. Place of jurisdiction
The place of jurisdiction is the domicile of the consumer. In international trading and in transactions with merchants, businesses, public special assets or legal persons under public law, the place of jurisdiction is Berlin in Germany.

13. Applicable law 

German law applies to the exclusion of the CISG.

14. final Provisions
If any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
